Class 35 in the Nice Classification covers “advertising, business management, business administration, office functions.” It is widely regarded as the most important defensive class for brand owners in China.
Trademark squatters in China frequently file in Class 35 for well-known brand names. If your brand is registered in Classes 9, 25, or 42 but not in Class 35, a squatter can register your brand name in Class 35 and offer “retail services” or “advertising” using your brand – actions that can confuse consumers and dilute your brand value.
We recommend including Class 35 in your China trademark strategy, especially if your brand has recognition in international markets.
