The Madrid System, administered by WIPO, allows brand owners to file a single international application covering up to 130+ member countries, including China.
1. The Madrid application depends on the “basic mark” for 5 years (central attack risk)
2. China’s examination of Madrid designations takes 12-18 months
3. Goods/services must be identical to the basic application
4. CNIPA issues a “grant of protection” or “refusal” notice
Direct CNIPA filing: Faster (8-12 months), more flexible spec, independent of basic mark. Madrid: More convenient for multi-country filers, potentially lower cost.
