China trademark registrations are valid for 10 years from the registration date. After that, you must renew to maintain protection. Missing the deadline does not mean instant loss, but the clock is ticking. Here is everything you need to know about renewal costs, grace periods, and restoration.

Standard Renewal: File On Time, Pay Less

Item Fee (RMB) Notes
Renewal application (per class) RMB 450 Electronic filing rate
Paper filing surcharge +RMB 50 Paper filing costs RMB 500 total

You can apply for renewal within 12 months before expiration. CNIPA processes renewals within 2–3 months and issues a renewal certificate confirming the new 10-year term.

The 6-Month Grace Period: A Costly Safety Net

If you miss the pre-expiration window, CNIPA provides a 6-month grace period after the expiration date. During this window:

  • Renewal fee: RMB 450 per class (unchanged)
  • Late renewal surcharge: RMB 225 per class
  • Total during grace period: RMB 675 per class
  • Your mark remains protected during the grace period

After the Grace Period: Restoration Is Possible but Complex

If more than 6 months have passed since expiration, your registration is formally cancelled. At this point:

  • You must file a new application (not a renewal)
  • There is a risk that someone else has already applied for the same or a similar mark
  • You lose the original priority date
  • In rare cases, you may argue “force majeure” for restoration if a natural disaster, pandemic, or other extraordinary event prevented timely renewal

Renewal Timeline at a Glance

T-6 months Recommended filing window for safety RMB 450/class
Expiration date Registration expires if not renewed
Expiry + 6 months Grace period: renew with late surcharge RMB 675/class
After grace period Registration cancelled; new application required New filing fees apply

Common Renewal Mistakes and How to Avoid Them

  • Relying on CNIPA to remind you: CNIPA does not send proactive renewal reminders to trademark owners. The duty to monitor deadlines rests entirely with you and your agent.
  • Confusing the registration date with the application date: The 10-year term runs from the registration date, not the filing date. Check your registration certificate carefully.
  • Renewing only some classes: If you registered in multiple classes, renew every class you still use or plan to use. Forgetting one class exposes your brand in that category.
  • Ignoring address changes: Renewal notices and correspondence go to the recorded address. Update it with CNIPA before the renewal period begins.
  • Assuming your agent will handle it automatically: Confirm in writing that your agent has renewal reminders in place and knows your expiration dates.

Smart Renewal Planning Tips

  • Set reminders at T-18 months and T-6 months: Give yourself and your agent ample lead time
  • Budget for total cost including agent fees: Agent service fees for renewal typically range from RMB 1,500–3,000 per class
  • Update your address: Ensure CNIPA has your current address to receive renewal notices
  • Check your trademark use evidence: If the mark has not been used for 3 consecutive years, it may be vulnerable to non-use cancellation

Renewing a Madrid Designation for China

If your China protection comes through the Madrid Protocol rather than a direct national registration, renewal is handled centrally through WIPO rather than CNIPA. You renew the entire international registration for a single fee, and the renewal automatically extends to all designated countries including China. Keep in mind that the Chinese portion of a Madrid renewal still depends on the validity of your underlying home registration.
