China offers multiple routes to enforce your trademark rights: administrative enforcement, judicial litigation, and customs recordal. Each has different strengths, costs, and timelines, and the right strategy often combines them.

1. Administrative Enforcement #

You can complain to the local Administration for Market Regulation (AMR) — the authority responsible for trademark infringement. Advantages:

  • Fast: raids can be conducted within days or weeks.
  • Low cost: no court fees and less formal evidence requirements.
  • Effective for counterfeits: AMR can seize and destroy infringing goods and impose fines.

Limitations: administrative actions stop the infringement but do not award you damages.

2. Judicial Enforcement (Litigation) #

For damages and injunctions, file a lawsuit in a Chinese court. Key points:

  • Damages: statutory damages up to CNY 5 million, plus punitive damages up to 5x for willful infringement.
  • Evidence: notarized purchases, infringement reports, and financial records.
  • Timeline: typically 6–18 months for a first-instance judgment.

3. Customs Recordal #

Record your trademark with China Customs to stop counterfeit imports and exports at the border. A customs recordal lasts 10 years and enables customs to seize infringing shipments. This is highly effective for brands that manufacture or ship through China.

  • Notarized purchase of infringing products (essential for litigation).
  • Photographs, invoices, and advertising of the infringing goods.
  • Online listings and platform take-down records.
  • Financial records showing the infringer’s sales volume.
