China Trademark Opposition, Invalidation & Cancellation: Complete Guide

Overview #

China offers several legal tools to challenge a trademark that threatens your rights — before registration through opposition, and after registration through invalidation and cancellation for non-use. Each has different grounds, deadlines, and costs.

1. Opposition (Before Registration) #

After a mark passes examination, it is published in the Trademark Gazette for a 3-month opposition period. During this window, any interested party may file an opposition on grounds such as:

  • The mark is identical or similar to your earlier rights.
  • The applicant filed in bad faith (e.g. squatting a well-known brand).
  • The mark is descriptive, deceptive, or otherwise unregistrable.

An opposition is decided by CNIPA and is a relatively low-cost way to stop a conflicting mark before it becomes a registered right.

2. Invalidation (After Registration) #

Once a mark is registered, you can request the TRAB to declare it invalid if:

  • The registration violates the Trademark Law (e.g. it is descriptive or deceptive).
  • The mark was registered in bad faith or by improper means.
  • It conflicts with your earlier rights.

For most grounds, an invalidation request must be filed within 5 years of registration. However, for well-known marks and marks registered in bad faith, there is no time limit.

3. Cancellation for Non-Use (“Revocation”) #

If a registered mark has not been genuinely used in China for 3 consecutive years, any party may request cancellation. This is a powerful tool to clear “dead” registrations that block your own application.

4. Well-Known Mark Recognition #

China gives enhanced protection to well-known marks, including cross-class protection and the ability to invalidate bad-faith registrations without a time limit. Recognition can be obtained through CNIPA administrative proceedings or court cases.
